2、ncludesanylead,cadmium,mercuryorhexavalentchromiumwhichisintentionallyintroducedasanelement.conegThelegislationisaimedatmetalsintentionallyintroducedtoapackageratherthanmetalswhichareincidentallypresentinthepackage.CONEGmodellegislationsetsforthconcentrationleve
3、lsforlead,cadmium,mercuryandhexavalentchromium.conegSpecifically,thesumoftheconcentrationlevelsmustnotexceed600partspermillion(“ppm”)byweight(0.06%)effective2yearsafterthestateadoptsthelegislation,250ppmbyweight(0.025%)effective3yearsafterthestateadoptsthelegisl
4、ation,and100ppmbyweight(0.01%)effective4yearsafterthestateadoptsthelegislation.However,theCONEGmodellegislationalsoprovidesexceptionstotheseconcentrationlevels.coneg.First,apackageisexemptfromthemodelact’srequirementsifitbearsacodeindicatingthatitwasmanufactured
5、beforetheeffectivedateofthelegislation..Second,apackageisexemptfromthemodelact’srequirementsifthelead,cadmium,mercuryorhexavalentchromiumwasaddedtothepackagetocomplywithhealthorsafetyrequirementsoffederallaworbecausetherewasnofeasiblealternative(i.e.theregulated
6、substanceisessentialtotheprotection,safehandlingorfunctionofthepackage’scontents).Inthesecircumstances,CONEG’smodelactrequiresthemanufacturertopetitionthestateforanexemption.conegThestatemaygrantatwo-yearexemptionifwarrantedbythecircumstancesand,insomecases,thee
7、xemptionmayberenewedfortwoyears.Finally,CONEG’slegislationcontainsanexemptionforpackagesthatwouldnotexceedthemaximumcontaminantlevelssetforthabovebutfortheadditionofpost-consumermaterials.Thisexemptionexpiressixyearsafterthestatelegislationisadopted.CONEG’smodel
8、legislationalsorequiresthatassoonasfeasible,butnotlaterthantwoyearsaftertheactisadopted,manufacturersorsuppliersofpackagesmustfurnishtopurchasersaCertificateofComplia
