1、摘要伴随着城市化进程产生的城市房屋拆迁活动，至今已有二十余年历史，它对实现城市规划目标、改善城市居民生活条件、合理利用土地资源等曾起到了积极作用。但城市房屋拆迁同时也牵涉到人民群众的切身利益，与国家经济发展和社会稳定密切相关，因此，拆迁中的矛盾纠纷历来是人们关注的焦点。中国人民共和国物权法》于2007年颁布实施，进一步完善了国家法律体系，提高了私权保护地位。在这一大背景下，城市房屋拆迁活动会受到怎样影响，能否找到解决矛盾的方法和途径，成为具有理论和实践双重指导意义的研究热点。我国关于城市房屋拆迁的研究目前仍处于摸索发展阶段

2、，理论体系比较零散，尤其缺乏深入的理论研究。本文以《物权法》颁布实施为契机，引入博弈论分析方法，希望进一步拓宽城市房屋拆迁理论研究的思路，同时也希望研究结论对拆迁实践具有一定指导意义。首先，在物权法背景下对城市房屋拆迁博弈要素进行分析，通过对几个主要城市房屋拆迁管理条例的对比，全面、系统地理清城市房屋拆迁主体关系的现状；在此基础上，以拆迁中各方主体的经济利益为研究对象，借助博弈论中“讨价-还价”模型，构建城市房屋拆迁基本主体的博弈关系，并采用逆向归纳法求解博弈均衡，提炼出物权法对城市房屋拆迁博弈的影响路径，加深了博弈在拆迁中
