3、ptotheoutsideworldandimprovetheconstructionofmarketcirculationsystem.ThepresentMeasuresareherebyformulatedinaccordancewiththeLawofthePeople''sRepublicofChinaonSino-foreignEquityJointVentures,theLawofthePeople''sRepublicofChinaonSino-foreignContractualJointVentures,LawofthePeople''sRepublicofC
4、hinaonWhollyForeign-ownedEnterprises,andtheCompanyLaw,andotherrelevantlawsandadministrativeregulations.Article2Whereaforeigncompany,enterpriseandothereconomicorganizationorindividual(hereinafterreferredtoas"foreigninvestors")establishesforeign-fundedcommercialenterpriseswithintheChinaterritor
5、yandundertakesbusinessactivities,thepresentMeasuresshallbeobserved.Article3The"foreign-fundedcommercialenterprises"shallrefertotheenterpriseswithforeigninvestmentwhichundertakethefollowingbusinessactivities:1.Commissionagency:sellingagents,brokers,auctioneersorotherwholesalersforgoods,whosell
6、goodsofotherpeopleandproviderelevantattachingservicesthroughcollectingfeesonthebasisofcontract;2.Wholesale:Sellinggoodstoretailers,customersofindustry,commerceandorganizations,ortootherwholesalersorprovidingrelevantattachingservices;3.Retail:providinggoodsforconsumptionanduseofindividualsorgr
7、oupsorofferingrelevantattachingservicesinthefixedplacesorthroughtelevision,telephone,mailorder,internet,andautomats;or4.Franchising:authorizingotherpeoplewithusingitstrademark,tradefirm,ormodeofmanagementthroughsigningcontractforgainingremune
