2、随着我国经济的高速发展，信用卡业务在我国的社会生活和经济活动中扮演越来越重要的角色。众所周知，信用卡是银行或有关机构发给资信较好的公司或个人，便利其购买商品、取得服务或者提取现金的信用凭证，由于信用卡的出现，便利了人们的生活，刺激了消费，但与此同时，由于信用卡本身的缺陷和当前信用卡制度的不完善，信用卡的使用也存在一定的风险。据有关机构统计，在一些国家和地区，信用卡诈骗造成的直接经济损失，每年就高达几亿美元。可见，惩治和防范信用卡诈骗犯罪是摆在世界各国面前的严峻课题。本文将重点对信用卡诈骗犯罪的构成要件和司法实践中出现的认定疑难问题加以阐释，主要包括四个部分：第一部
3、分，信用卡诈骗罪概述，包括信用卡的界定、信用卡诈骗罪的概念和特点;第二部分，信用卡诈骗罪的构成要件,包括主体要件、客体要件、客观要件和主观要件；第三部分，信用卡诈骗罪的司法认定，包括信用卡诈骗罪的罪与非罪界限和信用卡诈骗罪的犯罪形态，以及司法实践中有关信用卡诈骗犯罪的几种特殊行为定性；第四部分，信用卡诈骗罪的立法完善，内容包括规定单位成为信用卡诈骗罪的主体和明确ATM成为信用卡诈骗罪的对象。关键字：信用卡诈骗罪，构成要件，认定疑难，立法完善42重庆大学本科学生毕论文ABSTRACTABSTRACTWiththerapiddevelopmentofChina'sec
