1、知识产权诉前证据保全问题研究摘要知识产权证据具有隐蔽性、易逝性和技术性等特点,当事人取证有较大的难度,人民法院是否采取证据保全措施成为了当事人能否胜诉的关键。在我国最新修订的《民事诉讼法》明确了诉前证据保全这一规定,最高人民法院《关于诉讼证据的若干规定》(以下简称《证据规定》)、《专利法》、《著作权法》、《商标法》等均对诉前证据保全相关内容做出相应的规定,但不完善,无法适应当下知识产权的迅猛发展,对相应的权利保护不到位。笔者通过一个具体案例引出诉前证据保全对知识产权诉讼的重要性,从而说明研究目的和意义,简述国内外目前对诉前证据保全制度的研究。首先对诉前证据保全的界定
2、和介绍其功能,其次对域外诉前证据保全的分析,接着分析我国目前对诉前证据保全的法律规定,再从这一程序中的几个方面内容进行具体分析,然后从知识产权领域上去分析我国目前在申请人的范围过窄、申请的条件和审查标准不细化、实施保全的主体和时限的问题的欠缺、担保的规定和数额未明确和保全的方法不完善几方面的问题,最后就以上的问题提出完善的建议。【关键词】知识产权;证据;保全;诉前证据保全IAbstracttheknowledgepropertyrightevidencehasthenatureofconcealment,perishableandtechnicalcharacter
