1、物业管理责任风险与风险的保险转嫁摘要我国的物业管理始于八十年代初,最早的物业管理开始于经济特区深圳,1988年伴随深圳住房制度改革,物业管理迅速发展。随着物业行业的不断发展,物业企业所产生的问题、造成的责任事故及物业管理与业主的纠纷不断涌现,物业管理公司与物业使用者之间的法律纠纷与日俱增,而且索赔金额也日益加大。这些都影响了物业管理水平的提高,影响了物业管理行业的发展。物业管理公司在日常的经营中面临着巨大的风险,如何转嫁风险成为摆在物业管理公司面前的一个难题。对于大多数公司来说,通过保险转嫁风险是处理风险的最佳方法。因此有必要加强物业管理责任保险的研究。本文第一章是阐述了物业发展的
2、背景,分析了我国物业发展的现状,及物业行业自身所面临的问题,并提出了一些建议。责任保险离不开法律法规的支持,只有通过法律严格界定相关行业的责任边界,才能谈及责任风险的界定及保险转嫁,本文第二章从我国目前相关法规对物业的责任界定和物业管理项目的产权区分所有权以及我国物业管理产权模式现状进行分析比较。第三章介绍了我国责任保险发展的现状,并针对物业责任保险的现行条款结合笔者物业责任险的销售体会,对物业责任保险及责任风险管理进行探讨,并提出自己的建议。第四章指出引入专业的保险中介人的必要性及积极意义。关键词:物业、管理、责任风险、保险4AbstractChina'spropertymana
