2、eDepartmentofEnvironmentandNaturalResourcesbuilding,VisayasAvenue,Dillman,QuazonCity.And.本矿产品享有协议由环境与自然资源部部长代表的菲律宾共和国（以下简称政府）和****（简称承包人）于2010年2月10日在奎松市签订。WITNESSETHWHEREAS,the1987ConstitutionoftheRepublicofthePhilippinesprovidesinArticleXII,Section2thereofthatalllandsofthepublicdomain,waters,minera
3、ls,coal,petroleumandothernaturalresourcesareownedbytheStateandthattheirexploration,developmentandutilizationshallbeunderthefullcontrolandsupervisionoftheState;根据菲律宾共和国1987年宪法第12条第2款，所有公共领域土地，水资源，矿产，煤炭，石油和其它自然资源属于国家所有，对其的勘探，开发与利用应该在国家的完全控制与监督下。WHEREAS,theConstitutionfurtherprovidesthattheStatemaydire
4、ctlyundertakesuchactivities,oritmayenterintoaCo-ProductionJointVenture,orMineralProductionSharingAgreementwithFilipinocitizens,orcooperatives,partnerships,corporationsorassociationsatleastsixtypercentumofwhosecapitalizationisownedbysuchcitizens;宪法进一步授权国家可以直接从事相关活动，也可以与菲律宾公民或者菲律宾公民至少占60%股份的合作社，合伙企业，公
5、司或者协会等机构合资合作或签订矿产品享有协议的方式进行。WHEREAS,pursuanttoRepublicActNo.7942,otherwiseknownas"ThePhilippineMiningActof1995"whichtookeffecton09April1995,theSecretaryoftheDepartmentofenvironmentandNaturalrecoursesisauthorizedtoenterintoMineralProductionSharingAgreementsinfurtheranceoftheobjectivesoftheGovernmenta
6、ndtheConstitutiontobolsterthenationaleconomythroughsustainableandsystematicdevelopmentandutilizationofmineralland;根据1995年4月9日生效的菲律宾矿产法（第7942号法律，1995），政府与宪法为了可持续地系统的开发利用矿产土地，促进支撑国民经济发展，授权环境与自然资源部部长签订矿产品享用协议。WHEREAS,theGovernmentdesirestoavailitselfofthefinancialresources,technicalcompetenceandskill,w
