1、因果关系的结构性要素标准探析民法论文　　内容提要：民商法上的因果关系标准一直被视为不解之法学难题，并长期困扰着司法实践。本文从因果关系标准问题的法哲学思考与可行性论证入手，对两大法系各国因果关系标准学说进行比较分析后，重新审视了因果关系标准的内在价值构成和因果关系标准的移植与本土化问题，提出了以法哲学、法医司法技术和法律规范等要素构成的、开放性的结构性要素新标准。　主题词：因果关系　　结构性要素标准　　探析——————————————————————　　民商法上的因果关系（cusation），直到现在仍一直被中外学者视为不解之法学难题。
