7、istributionofmainbranches,branches,trunkdiameterabove15对产权的含义有着极为丰富的理解而且经常引起混淆主要原因应归于对产权理解角度的差异这一差异首先来自法学界与经济界的不同认识而从另一方面西方产权理论通过“法和经济学”的充分融合经过半个多世纪的发展已发展成为自成体系的、具有丰富内涵的、并拥有大批颇有建树及代表人物的现代产权经济学派随着我国对西方产权理论的引进加上我国原有的对所有权（制）研究以及法学研究的理论基础配合正在改革的产权制度实践在研究上也逐渐显示出带有中国特色的“产权
8、”观念因此经过法学、经济学观念的矛盾与协调以及中、西方观念的矛盾与协调对产权理解的多样性和复杂性也就不足为奇（伍中信1998）一个对产权的简短定义是“主体拥有的对物和对象的最高的、排他的占有权”（刘诗白1995）更具体地说产权即财产权(PropertyRight
