1、论代驾纠纷的解决途径———以代驾合同性质分析为视角摘要这段时间以来，我国的交管机构对于喝酒之后开车的处罚越来越重，因此，出现了一种全新的服务，那就是代驾。就延吉市而言，近四年来就有三十多家公司陆续开始从事着代驾服务行业。可是，在此行业发展的过程中，由于受到理论争议、法律法规空白、政府监管缺乏、行业协会空缺的众多因素影响，使得这个新兴行业的发展并非一帆风顺，代驾纠纷案件频发。由于没有明确的法律规定，学术界对于代驾合同的性质一直存在争议，使得各地法院在审理此类案件时依据不一、理由各异，没有统一的规定，而且有关代驾的法律案件始终不能很好地判决。当然，我们还应清楚的看到，
2、立法缺失、政府部门和社会的监管缺位也多多少少在源头和纠纷解决过程中有着不可推卸的责任。如此观之，合理妥善的解决代驾纠纷是一个需要多方合力、共同完善的综合问题。所以，本片论文以有关合同的法律作为突破点，确认代驾合同是否具有法律效力以及当中责任的归属，辅之以立法、行政监管、行业协会等多方完善建议，以期探索出一条代驾纠纷解决的有效途径，使代驾行业能够得到法律和制度上的规制和保障，从而更好的适应市场。关键词：代驾合同性质无名合同法律责任AbstractSincethisperiodoftime,thetrafficcontrolmechanisminourcountryf
