2、bruary2013,25EUMemberStatessignedtheAgreementonaUnifiedPatentCourt(UPC).ThiscommittedtheContractingMemberStatestoestablishaCourtcommontothemwithexclusivejurisdictionforfutureEuropeanpatentswithunitaryeffect(UnitaryPatentProtection,UPP)aswellasforEuropeanpatentsvali

3、datedinoneorseveralofthecontractingstates–“classical”Europeanpatents.Theaimofthereformistoofferbusinessanalternativebysimplifyingtheexistingsystemandsupportacosteffectiveroutetopatentprotectionanddisputesettlement.Itwillstillbepossibletousethenationalrouteforthosep

4、referringtoseekprotectioninindividualMemberStatesandtovalidateaEuropeanpatentinoneorseveralMemberStates.Itwillalsobepossibletocombinethenewsystemwiththe1)Regulation(EU)No1257/2012oftheEuropeanParliamentandoftheCouncilof17December2012implementingenhancedcooperationi

5、ntheareaofthecreationofunitarypatentprotection,CouncilRegulation(EU)No1260/2012implementingenhancedcooperationintheareaofthecrea-tionofunitarypatentprotectionwithregardtotheapplicabletranslationarrangements.2oldoneandhaveaEuropeanPatentwithunitaryeffectandinadditio

6、nvalidatethepatentasaclassicalEuropeanPatentinotherEPCContractingStates.ConsequentlytherewillbethreeroutestopatentprotectioninEuropeinthefuture.InnovationNPONPOEPOEPONPONPONPONPONationalPatentEuropeanPatentEuropeanPatentwithUnitaryEffectNPO=NationalPatentOfficeEPO=
