2、echaracteristicofitsobjectivity.Thepriorityofobjectivityresonateswiththeideaofscientificthinking.Thepriorityofobjectivityinlegaltheoryfindsthetheoryofanobjectivelyascertainablepedigreeacriticalcriterionforthevalidityofalegalproposition.Similarly,theprioritygiventoobjec

3、tivityweakensorprecludesaroleformoralityinjurisprudentialdiscourse.Moralityisnotvalidatedbytheideaofanobjectivelyascertainablepedigree.Itisnotamenabletothemethodsbywhichascientifictruthisvalidated.Inmoralpropositions,currencyisnotenhancedorunderstoodinthelanguageofcaus

4、eandeffectorformallogicaldiscourse.Itscurrencyonlymakessenseinthequalityandtherigoroftheworldof‗ought‘discourse.Todayitiscommonlyassumedthatthecurrencyofethicsandmoralityisdefendedbythetoolsofjustification.Theextenttowhichthetoolsofjustificationfromtimetotimeenterthewo

5、rldoflegaldiscoursecreatesspaceformoralityandethicstoentertheworldofpositivisticlegalthought.Inthischapter,Iexploresomeofthedimensionsoftheobjectiveandthesubjectivecomponentsoflegaltheory.Oneofthemostimportantobjectivesofruleandprecept-focusedjurisprudenceistosecurefor

6、law,andtheintellectualframebehindit,atheoreticalbasisforan‗objective‘legalorder.Aframethatfocusesonobjectivelyverifiablerulesorotherpreceptsmeetsthisconcern,andthosewhoseektomodifyorotherwisetinkerwiththedominant(rulesoriented)lawviewmustmeetthecriterionof‗objectivity,
