1、摘要面对历久弥新的死刑问题，本文以《中华人民共和国刑法修正案(八)》为视角，反思我国死刑制度的现状和不足，对我国死刑的立法控制的进一步完善提出粗浅的建议，以期对限制死刑问题的妥善解决有所裨益。、本文首先对《中华人民共和圉刑法修正案(八)》进行解读，简要的概述了《刑法修正案(八)》的关于死刑限制方面的内容，主要包括：取消13个犯罪的死刑罪名；限制死刑适用对象；为配合死刑罪名的取消而调整刑罚体系结构。在解读《刑法修正案(八)》的基础上，对当代中国限制死刑必要性问题进行讨论。简要地分析了我国所面临的死刑废除世界潮流的压力，经济发展、人权保障的需要以及死刑

2、制度本身的局限性。然后论述了废止、限制死刑适用的町行性。文章从刑法目的和刑罚功能两方面入手，分析了死刑威慑力与预防犯罪能力的有限性。并讨论了传统法律文化的影响。最后，提出完善我国限制死刑的立法建议，主要包括生命权入宪，犯罪的死刑罪名的进一步删减以及死刑适用对象的限制。关键词：死刑；刑罚体系；人权nABSTRACTFacingthenewproblemoftheolddeathpenalty，thispaperwil1make，fromperspectiveoftheAmendmentstotheCriminalLawofthePeople’SRep
